Rules of Procedure
Using ADR, you can choose your arbitrator or a panel of arbitrators. You can even select the rule of procedure to use for the arbitration, the schedule, and if and to what extent discovery should be allowed. As a result, you can select arbitrators who understand and have empathy for your cause, rather than a jury who are not tuned into your type of claims.
Transfers After-the-Fact
Let’s say that you have an agreement that calls for arbitration (or mediation) with a more expensive company. Simply agree and consent to “submission” of the case to ADR.
